Terms & Conditions

I. Scope of Application

These General Terms and Conditions apply to all contracts for the provision of hotel rooms for accommodation and all further services and deliveries of the hotel. Deviating conditions of the customer shall only apply if the hotel has expressly confirmed them in writing.

Sub-letting of the rooms provided and their use for purposes other than accommodation requires the prior written consent of the hotel.

II. Contract Formation

The contract is concluded upon acceptance of the customer's offer by the hotel. The hotel is free to decline a booking without giving reasons. If a booking is made by a third party, that party shall be jointly and severally liable to the hotel for all obligations arising from the contract.

All agreements between the hotel and the customer require written form. Unilateral amendments or additions by the customer are invalid.

III. Services, Prices and Payment

The hotel is obliged to hold the rooms booked by the customer and to provide the agreed services. All prices are inclusive of applicable VAT.

If, after the conclusion of the contract, the hotel's costs for providing these services increase, the hotel may increase the agreed prices appropriately, provided that more than four months have elapsed between conclusion and performance of the contract and the increase would exceed 10%.

Hotel invoices without a due date are payable immediately upon receipt without deduction. The hotel is entitled to call in outstanding claims at any time. In the event of late payment, the hotel is entitled to charge interest at 5% above the base rate (consumers) or 8% above the base rate (businesses). A reminder fee of €5.00 will be charged per reminder.

IV. Customer Cancellation

Standard Periods

• Free cancellation up to 2 days before arrival, 6:00 pm local time
• Cancellation thereafter: 90% of the total price
• No-show: 100% of the total price

Peak Season

• Free cancellation up to 7 days before arrival, 6:00 pm
• Cancellation thereafter: 90% of the total price

Trade Fair Periods

Groups (8 or more persons)

• Free cancellation up to 7 days before the event
• Cancellation thereafter: €50.– per person

V. Hotel Cancellation

Where it has been agreed that the customer may withdraw from the contract free of charge within a certain period, the hotel is likewise entitled to withdraw during that period if enquiries from other customers are received and the customer, upon enquiry from the hotel, does not waive his right of withdrawal.

The hotel is furthermore entitled to terminate the contract extraordinarily for good cause, for example in the event of late payment, false information provided at the time of booking, force majeure or unauthorised sub-letting.

VI. Arrival and Departure

Check-in: 3:00 pm – 6:00 pm. The hotel must be informed in advance of later arrivals, as there is no night porter on duty.

Check-out: 7:00 am – 11:00 am. If the customer vacates the room after 6:00 pm, the hotel may charge the full room rate for use beyond 6:00 pm.

VII. Hotel Liability

The hotel is liable for damage to the customer arising from injury to life, body or health. For other damage, the hotel is only liable where it is attributable to the hotel's gross negligence or wilful misconduct.

The hotel is liable for items brought in by guests in accordance with statutory provisions. The hotel recommends using the in-room safe. Liability limits: max. €3,000.– (€800.– for cash and valuables; €3,000.– in the safe).

No-Smoking Policy

The entire hotel is a non-smoking area. Violations will incur a flat-rate cleaning fee of €400.–; in the event of serious violations the flat rate may amount to €1,500.–.

Car Park

The hotel accepts no liability for vehicles in the hotel car park. The car park is provided free of charge and without any obligation of supervision.

VIII. Restaurant and Events

Deposit

For event bookings, a deposit of 50% of the total amount is due 7 days before the event.

Event Cancellation Fees

• From booking up to 3 months before the date: 10% of the agreed total amount
• 3 months to 6 weeks before the date: 30%
• 6 weeks to 2 weeks before the date: 60%
• Less than 2 weeks before the date: 100%

Late-Night Surcharge

From 12:30 am, a late-night surcharge of €450.– per commenced hour will be charged.

Restaurant No-Show

In the event of a no-show without prior cancellation, €50.– per person will be invoiced.

IX. Final Provisions

Amendments or supplements to the contract, the acceptance of the offer, or these T&Cs require written form. Unilateral amendments or additions by the customer are invalid.

Place of performance and exclusive place of jurisdiction – including for cheque and bill of exchange disputes – in commercial transactions is Düsseldorf.

German law applies. The application of the UN Sales Convention and conflict-of-law rules is excluded.

Should individual provisions of these T&Cs be invalid or void, the validity of the remaining provisions shall not be affected.
